Terms of Service

1. Acceptance of terms

By creating an account, downloading, installing, accessing, or otherwise using Media Forge (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use the Service.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. By using the Service you confirm that doing so is lawful in your jurisdiction of residence.

2. Description of service

Media Forge provides software tools for managing multiple social media accounts, including browser profile isolation, proxy management, content scheduling, content transformation, and related publishing and account-management utilities.

Media Forge is a general-purpose software tool. We do not control, direct, or monitor how you use it, and we are not a party to your relationship with any third-party platform you connect to or interact with through the Service.

You may use Media Forge for both personal and commercial projects, subject to your compliance with these Terms.

3. Subscriptions and billing

Media Forge is offered on a monthly subscription basis across the Lite, Pro, and Max plans. Subscriptions renew automatically until cancelled. You may cancel at any time; access continues through the end of the current billing period.

We may change our pricing at any time. Changes will not affect a billing cycle you've already paid for, and we'll give you reasonable notice before a price change applies to your next renewal.

4. Accounts and licenses

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

You must provide accurate information when creating an account and keep it up to date.

Your license is tied to your account and is seat-limited. If you move your installation to a new computer, free up your existing seat first from your account settings — otherwise you may be temporarily unable to activate the Service on the new device. You may not share your activation credentials; each user needs their own license.

5. Acceptable use

You agree not to use Media Forge to:

• violate any applicable law or regulation;
• defraud, deceive, or impersonate any third party, platform, advertiser, or financial institution;
• distribute unlawful, infringing, hateful content, or content that endangers minors;
• infringe the intellectual property, privacy, or publicity rights of others;
• spam, phish, or distribute malware;
• create fake engagement, fake reviews, or fabricated social proof intended to deceive consumers or third parties;
• resell or provide access to the Service to third parties outside your subscription tier;
• interfere with, disrupt, or overload our infrastructure;
• scrape, crawl, or programmatically access our site or servers beyond normal use, without our permission.

You are solely responsible for complying with the terms of service, community guidelines, and policies of any third-party platform you connect to or interact with through Media Forge. We make no guarantee that use of the Service will not result in suspension, restriction, or termination of your account on any third-party platform.

We may investigate and take action against violations of this policy, including suspending or terminating access, with or without notice.

6. Intellectual property

Media Forge, including its source code, design, and trademarks, is our exclusive property. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own purposes, subject to your compliance with these Terms. Purchasing a license does not transfer ownership of the software or its intellectual property.

You may not reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software, or modify it, except to the extent applicable law prohibits this restriction.

You retain all rights to content you upload or process through the Service. You represent that you own or have the necessary rights and permissions for any content you upload, process, or distribute through the Service.

7. Third-party platforms

Media Forge is not affiliated with, endorsed by, or officially connected to any third-party social media platform it supports. Third-party platforms may change their policies or detection systems at any time without notice, and we don't guarantee continued compatibility or effectiveness of the Service with respect to any of them.

8. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted or error-free, or that any account or content will not be flagged, restricted, or removed by a third-party platform.

We recommend keeping your own backups of your content and account configurations before running bulk publishing, scheduling, or transformation operations.

9. Limitation of liability

To the maximum extent permitted by law, Media Forge and its officers, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or account access on any third-party platform, arising from your use of the Service.

Our total liability arising out of these Terms or the Service will not exceed the amount you paid us in the twelve months before the claim arose. Nothing here limits liability that cannot be limited under applicable law.

10. Indemnification

You agree to defend and indemnify Media Forge and its officers, employees, and agents against claims, damages, and expenses arising from your use of the Service, your violation of these Terms, your violation of any third-party right, or content you upload or distribute through the Service.

11. Support

We provide reasonable email support for active subscribers. Unless a separate signed agreement says otherwise, Media Forge does not include guaranteed response times, uptime commitments, or service credits.

12. Termination

We may suspend or terminate your access at any time, with or without cause or notice, including for violation of these Terms. You may cancel your subscription at any time through your account settings.

If we terminate your access without cause and through no fault of your own, we will provide a full refund for your current billing period.

13. Refunds

We offer a 7-day money-back guarantee on new subscriptions, provided your account hasn't exceeded normal usage limits during that period. Contact support within 7 days of your initial purchase to request a refund.

14. Privacy

Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. Where applicable, we process personal data in accordance with the EU General Data Protection Regulation (GDPR).

15. Governing law

These Terms are governed by the laws of Romania, without regard to conflict-of-law principles. Disputes will first be attempted to be resolved through good-faith negotiation, and if unresolved, submitted to the competent courts of Romania — except where mandatory consumer-protection law gives you the right to bring proceedings in your own country of residence.

16. Changes

We may update these terms from time to time. We'll notify you of material changes before they take effect. Continued use of the service after changes take effect constitutes acceptance of the revised terms.
